Issue Brief: Creating Good Habits: Fixing Michigan’s Habitual Offender Laws

Michigan’s one set of habitual offender enhancement statutes, MCL 769.10 through 769.12, imposes progressively severe penalties on individuals with prior felony convictions by increasing sentence maximums. Consequently, depending on the number of charges and convictions an individual has from their first contact with the criminal legal system, a habitualized individual can, if they reoffend, receive a life sentence for offenses that normally do not carry a life sentence. This outcome is neither intended by the lay public nor consistent with legislators’ goals when they enacted the law.
